Police want to take cycle case further

The Dominion (Wellington, New Zealand), August 30, 2001

CYCLE courier Paul Everitt, who won a claim that police had breached his rights when they strip-searched him, may have to defend himself before the Privy Council in London.

The Crown has lodged an application in the Court of Appeal for leave to appeal to the Privy Council. This will be heard on September 17.

In July, the court found that Mr Everitt's rights had been breached when police strip-searched him in the cells at Wellington Police Station in February 1998 after they stopped him for going through a red light on his bicycle. He was arrested and charged with assaulting a police officer after his bicycle hit one of them in the chest when she asked him to turn it over so she could see the serial number.
